Successful employment on the cruise ship, Kharkiv
Serhiy found the intermediary agency, which offered employment in the sea-faring industry, through the internet: agency’s website contained information about its services and terms of cooperation with the clients. Serhiy was attracted by the possibility to be employed at the reception on the cruise-liner.
In December 2006 Serhiy contacted Centre for Migrant Advice (CMA) in Kharkiv for advice, whether he can trust this intermediary. CMA consultant gave Serhiy the phone number of the Ministry of Labour and Social Policy of Ukraine (MLSP) - (044) 289-50-97, where he could check whether the intermediary had the license of the MLSP for providing the intermediary services. Consultant also acquianted Serhiy with the most wide-spread fraudulent schemes and emphasized on the necessity to sign an agreement with the intermediary.
After having checked the license of the intermediary and having received all the necessary information on how to safeguard himself while working with intermediaries (i.e. clients' rights and obligations of the intermediary agency), Serhiy went to the office of the agency. There he was offered to pay $500 for intermediary services in employment abroad, which consisted of: search of the employer, conclusion of the labour contract with this employer and provision of the consultative services at all stages of obtaining of a work visa in the embassy. After consultations with CMA on the legal aspects of the contract Serhiy accepted the offer of the agency and signed the agreement.
Now he has been working already for 2 years at the big cruise-liners. When CMA consultant asked Serhiy whether he felt any discrimination or exploitation from the employer’s side, he told that hopefully he had not experienced any. But if even something similar happens (when employer violates the terms of the labour contract etc), one should be aware of the existence of a special organization that protects workers' rights - International Transport Worker’s Federation (ITF). In a case of rights' abuses any cruise-liner worker can turn for help to this organization in the nearest port.
